Terms of Service

These Terms of Service ("Terms") govern your use of shbd (available at https://shbd.bioinfo.guru, the "Service"), a Markdown editor with Mermaid diagram support, syntax highlighting, and PDF export. By accessing or using the Service, you agree to these Terms.

1. Eligibility and Accounts

1. You must be at least 13 years old (or the minimum age required by your local law) to use the Service.
2. Accounts are created via third-party authentication providers (Google or GitHub). You are responsible for maintaining the security of those provider accounts and for all activity that occurs under your shbd account.
3. You must provide accurate information to your authentication provider and keep your account credentials confidential.

2. Use of the Service

The Service lets you create, edit, render, export, and store Markdown documents. Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to use the Service for personal or internal business purposes.

3. Your Content

1. Ownership. You retain all rights to the documents and content ("User Content") you create or upload. We claim no ownership over it.
2. License. You grant us a worldwide, royalty-free license to host, store, reproduce, and process your User Content solely as necessary to operate and provide the Service (including storage on cloud infrastructure, rendering, AI-assisted features you invoke, and PDF export).
3. Responsibility. You are solely responsible for your User Content and for ensuring you have the rights to store and process it through the Service.

4. Acceptable Use

You agree NOT to:

• Use the Service for unlawful purposes or to store, publish, or transmit unlawful, infringing, malicious, or harmful content;
• Upload malware, attempt to gain unauthorized access, probe, scan, or disrupt the Service or its infrastructure;
• Circumvent usage limits, rate limits, or access controls;
• Use the Service to abuse third-party APIs (including AI providers) or violate their terms;
• Harass, threaten, or infringe the rights of others;
• Resell, sublicense, or provide commercial hosted access to the Service without written permission.

5. Cloud Storage and Availability

1. Your documents are stored on third-party cloud providers (managed databases such as Turso/libSQL, hosted on networks such as Cloudflare). Availability and durability depend in part on those providers.
2. The Service is provided without a guaranteed uptime commitment. It may be suspended or modified for maintenance, updates, or reasons beyond our control.
3. Backups are your responsibility. Keep your own copies of important documents. We are not liable for lost, corrupted, or deleted content.

6. Third-Party Services

The Service integrates third-party services, including Google and GitHub (authentication), Cloudflare (hosting), Turso (database), Google Gemini (AI features), and external PDF rendering services. Your use of those features is also subject to the respective providers' terms and policies. Features that rely on third-party APIs may change or become unavailable if those providers change their offerings.

7. Intellectual Property

The Service itself—including software, design, branding, and documentation—is owned by its operators and licensors and protected by intellectual property laws. Nothing in these Terms transfers ownership of the Service to you.

8. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE OPERATORS OF THE SERVICE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF DATA, PROFITS, OR GOODWILL ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ALL CLAIMS SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM, OR (B) USD $50.

10. Suspension and Termination

1. You may stop using the Service and delete your documents at any time.
2. We may suspend or terminate your access immediately if you breach these Terms, create risk or legal exposure for us, or for extended inactivity where technically necessary.
3. Upon termination, your right to use the Service ends. Associated data may be deleted per our Privacy Policy retention practices.

11. Changes to the Service and These Terms

We may modify the Service or these Terms at any time. Material changes will be posted on this page with an updated date. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.

12. Governing Law

These Terms are governed by the laws applicable at the operator's principal place of business, without regard to conflict-of-law rules. Any disputes will be resolved in the courts of that jurisdiction, unless mandatory local law provides otherwise.
